This Privacy Policy explains how The Law Practice Exchange, LLC (“LPE,” “we,” “us,” or “our”) collects, uses, shares, and protects information about you when you visit our websites (including thelawpracticeexchange.com and themarketplace.law, our “Sites”), use The Marketplace, or use our advisory and professional services (together, the “Services”).
It applies whether you interact with us as a website visitor, a prospective or current client, or a Marketplace user. Where this Policy is incorporated into the Marketplace Terms & Conditions, it also supplements those terms. By using the Services, you agree to this Policy.
1. SCOPE & ABOUT THIS POLICY
This Policy applies to information we collect through the Services — including when you browse our Sites, submit an inquiry or contact form, subscribe to our communications, register for an event, create or use a Marketplace account, or engage LPE for advisory or other professional services. A specific engagement or agreement may include additional privacy terms; in that case, this Policy continues to apply except to the extent those terms state otherwise. This Policy does not apply to third-party websites or services we do not control. Capitalized terms not defined here have the meaning given in the Marketplace Terms & Conditions and LPE’s Standard Terms & Conditions.
2. INFORMATION WE COLLECT
We collect information in three ways: information you provide, information collected automatically, and information we receive from third parties.
Information you provide. Registration and account details (such as your name, email address, phone number, mailing address, firm or entity name, role, and professional information such as bar admission or licensure where requested); identity and eligibility verification information; the content of your listings and profile; messages and materials you exchange with other users or with LPE; financial and transaction information needed to determine and collect the Exchange Fee (such as gross revenues, letters of intent, and closing statements); payment information (processed through our payment processor); and any information you provide in support requests, forms, or surveys; and information you provide when you contact us, request information, subscribe to our communications, register for an event, or engage LPE for advisory or professional services.
Information collected automatically. When you visit our Sites or use the Services, we and our service providers automatically collect device and usage information — such as IP address, browser and device type, pages and listings viewed, links clicked, referring pages, and the dates and times of access — including through cookies and similar technologies described in Section 4.
Information from third parties. We may receive information from identity-verification and fraud-prevention providers, our payment processor, analytics providers, cooperating advisors or brokers, referral sources, and publicly available sources, and we may combine it with information we already hold.
Sensitive information. We generally do not request sensitive personal information. Certain information we do collect — such as the fact that a firm is for sale and detailed financial information about a practice — is treated as Confidential Information under the Marketplace User NDA and the Standard Terms.
3. HOW WE USE YOUR INFORMATION
We use the information we collect to:
operate, maintain, secure, and improve our Sites, The Marketplace, and the Services;
create and manage your account and verify your eligibility and identity;
facilitate introductions and communications between users;
calculate, invoice, and collect the Exchange Fee and process payments;
detect, investigate, and prevent fraud, abuse, and security incidents, and enforce our Terms;
communicate with you about your account, transactions, and service updates, respond to your inquiries and requests, and provide customer support;
send marketing or informational messages, from which you may opt out; and
comply with legal obligations and establish, exercise, or defend legal claims.
We may also create and use de-identified or aggregated information, which does not identify you, for any lawful purpose.
4. COOKIES & TRACKING TECHNOLOGIES
Our Sites and The Marketplace use cookies and similar technologies (such as pixels and local storage) to keep you signed in, remember your preferences, measure and analyze how our Sites and platform are used, maintain security, and support our communications. These fall into four general categories: strictly necessary, functional, analytics and performance, and advertising. Some of these technologies are set by us, and some are set by our service providers.
You can control cookies through your browser settings and, where we offer them, through our cookie controls, and you can use any opt-out tools made available by the third-party providers of those technologies. Disabling some cookies may affect how the Services function. Where required by law, we honor recognized opt-out preference signals, such as the Global Privacy Control (GPC).
5. HOW WE SHARE YOUR INFORMATION
We share information in the following circumstances:
With other users. The Marketplace works by connecting users, so certain profile, listing, and communication information is shared with the users you interact with. That sharing is subject to the Marketplace User NDA and the confidentiality obligations in our Terms, which restrict how other users may use your Confidential Information.
With service providers. We share information with vendors who perform services for us — such as hosting, payment processing, identity verification, analytics, communications, and security — under contracts that limit their use of the information to providing those services.
With cooperating advisors and brokers. Where a relationship requires a licensed broker or other cooperating advisor, we may share information as needed to facilitate it, consistent with the Standard Terms.
At your direction or with your consent. We share information when you ask us to or otherwise consent, including with your own professional advisors.
For legal and safety reasons. We share information to comply with law, respond to lawful requests, enforce our agreements, and protect the rights, safety, and property of LPE, our users, and others.
In a business transfer. If LPE is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
We do not sell your personal information for money, and we do not “share” your personal information for cross-context behavioral advertising as those terms are defined under California law.
6. CONFIDENTIAL MARKETPLACE INFORMATION
Information such as the identities of users, the fact that a firm is for sale or seeking to buy, and the substance of Marketplace discussions is treated as Confidential Information under the Marketplace User NDA and the Standard Terms. Those agreements — not this Policy — govern the obligations users owe one another with respect to Confidential Information.
7. DATA RETENTION
We retain information for as long as needed to provide the Services, maintain your account, comply with our legal, tax, and recordkeeping obligations, resolve disputes, and enforce our agreements. This includes records relating to introductions and the Exchange Fee, which we may retain after your account closes.
8. DATA SECURITY
We use reasonable administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials and for notifying us promptly of any unauthorized use of your account.
9. YOUR CHOICES
You can review and update your account information by signing in or contacting us; opt out of marketing emails using the unsubscribe link in those messages or by contacting us (we may still send you service-related messages); and control cookies as described in Section 4.
10. YOUR U.S. STATE PRIVACY RIGHTS
Depending on your state of residence, you may have additional rights regarding your personal information. We honor the rights described below to the extent they apply to you, and we will not discriminate against you for exercising them.
California (CCPA/CPRA). In the preceding 12 months, we have collected the categories of personal information summarized below, from the sources and for the purposes described in Sections 2 and 3, and have disclosed them to the categories of recipients described in Section 5. California residents may request to know or access, delete, or correct their personal information; opt out of the sale or sharing of personal information; limit the use of sensitive personal information; and exercise these rights free from discrimination.

Virginia, Colorado, Connecticut, Texas, and other states. If you reside in a state with a comprehensive privacy law, you may have the right to confirm whether we process your personal data and to access it; to correct inaccuracies; to delete it; to obtain a portable copy; and to opt out of targeted advertising, the sale of personal data, and certain profiling. State laws and the specific rights they provide vary and continue to change.
How to exercise your rights. You or your authorized agent may submit a request by emailing info@thelawpracticeexchange.com. We will take steps to verify your identity before responding and will respond within the time required by applicable law. We may decline requests as permitted by law.
Appeals. If we decline your request, you may appeal by contacting us at info@thelawpracticeexchange.com. If you have unresolved concerns, you may also contact your state attorney general.
11. CHILDREN’S PRIVACY
The Marketplace is intended for users who are at least 18 years old. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it.
12. THIRD-PARTY LINKS & SERVICES
The Marketplace may link to or integrate with third-party websites and services that we do not control. Their handling of your information is governed by their own privacy policies, and we are not responsible for their practices.
13. CHANGES TO THIS POLICY
We may update this Policy from time to time. We will post the updated version with a new Effective Date and, where required, provide additional notice. Your continued use of The Marketplace after an update takes effect means you accept the revised Policy.
